Bustamante awaiting sentencing for murder of 9 year old neighbor

Alyssa Bustamante, the convicted killer of 9 year old Elizabeth Olten, of St.  Martins Missouri, is to be sentenced on February 6, 2012 after confessing to the crime Tuesday. She has pled guilty to the charge of 2nd degree murder.

Current Missouri statute requires that any inmate convicted of 2nd degree murder is to serve a minimum of 85 percent of his or her original sentence.

In this case, Cole County Circuit Judge Pat Joyce said in court that the crime could carry a sentence of 10 years to 30 years in prison, or life, both with the possibility of parole. The Mo. Dept. of Corrections has confirmed that a life sentence in Missouri is 30 years, and that Bustamante would be required to serve at least 25.5 years of that imprisoned.

The armed criminal action charge should carry a minimum of three years, which could either be ordered to run concurrent or consecutively with the murder sentence.

Bustamante is expected be held at one of Missouri’s two women’s prisons in Vandalia or Chillicothe.
